1. Australian Consumer Law (ACL)
TUS & TR Pty Ltd trading as Dexon Division (ACN 680 909 102) (Dexon, we, us or our) products come with guarantees that cannot be excluded under the ACL.
For major failures with products, you are entitled to:
· cancel your contract with us; and
· to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problems with the products rectified in a reasonable time and, if this is not done, to cancel your order and obtain a refund for the unused portion of the order.
2. Our Warranties
We warrant that:
· the products are of merchantable quality and will be free from defects for the warranty period of 2 years (Warranty Period) from the date of original purchase;
· the products will be fit for the purpose for which products of the same kind are commonly supplied and any other purpose which has been notified by us;
· the products will match the description of the products as described on our website, labelling or in any advertising;
· we have the right to sell the products and the products are free from any charge or encumbrance; and
· the products and any spare parts comply with applicable laws and standards.
The Warranty Period applies to harnesses and accessories in respect of manufacturing defects only (see section 6 below).
3. What this Warranty covers
During the Warranty Period, we will, acting reasonably and at our discretion, and subject to the ACL:
· repair the product; or
· replace the product with an identical product; or
· provide a refund where required by law.
The Warranty in this section 3 applies to the product only and does not apply to labour costs, installation, removal, refitment, diagnostics, or any associated costs.
4. What this Warranty does not cover
The Warranty does not apply where, in our opinion acting reasonably:
· the product has been misused, altered, neglected, damaged, or subjected to accident;
· the product has not been installed in accordance with the installation instructions;
· the product has not been installed in accordance with the vehicle or equipment manufacturer’s recommendations;
· the product has been installed incorrectly, including incorrect wiring or improper voltage supply;
· the product has been used with power supplies outside the specified minimum or maximum voltage range or type;
· damage has occurred due to vehicle electrical system faults;
· water ingress has occurred due to incorrect installation, sealing, or mounting;
· the product has been repaired, disassembled, or modified without our prior written permission;
· the product has been used with components, wiring, or controllers which have not been recommended by us; or
. the product has been used in a manner inconsistent with its intended purpose.
5. Excluded Damage and Conditions
The Warranty excludes products which:
· have sustained normal wear and tear;
· have cosmetic damage including scratches, stone chips, discolouration or fading;
· are corroded due to environmental conditions including salt, chemicals, or pollutants;
· are damaged due to pressure washing or high-pressure water exposure;
· are damaged due to acts of nature, including but not limited to flood, fire, lightning, or extreme weather events; and
· incur any labour costs associated with installation, removal, refitment, diagnostics, or vehicle downtime.
6. Wiring Harnesses and Accessories
Wiring harnesses and related accessories are covered by the Warranty Period against manufacturing defects only, commencing from the date of purchase. The Warranty applies only to unmodified harnesses. Proper maintenance of wiring harnesses is your sole responsibility. Corrosion, contamination, or damage caused by lack of maintenance is not covered by the Warranty.
7. Replacement Products
If a product is replaced under the Warranty:
· the replacement will be an identical product only;
· upgrades or substitutions to alternate products are not available;
· the replacement product will carry the remaining balance of the original Warranty Period.
Warranty Periods do not restart upon replacement.
8. Warranty Claims Process
All warranty claims must be submitted using our warranty claims process (available on our Website at www.dexon.com.au or by contacting us via our Website) and require approval prior to return. We may require the following to assess a warranty claim:
· proof of purchase (invoice, receipt, or order number);
· photos and/or videos demonstrating the fault;
· installation details or images where reasonably required;
· personal identification where required to verify ownership.
We reserve the right to inspect and assess all returned products. A Return Merchandise Authorisation (RMA) must be issued by us before any product is returned. Products returned without an approved RMA may be refused. We must receive the faulty product before a warranty repair or replacement is processed.
9. Shipping Costs
You are generally responsible for the cost of shipping products to us for warranty assessment. Where a warranty claim is approved, we will cover the cost of return shipping. In some cases, we may elect to cover shipping costs both ways at its discretion.
10. Transferability
The Warranty is non-transferable and applies only to the original purchaser of the product. This does not limit or exclude any rights a consumer may have under the ACL.
11. International Customers
For customers located outside Australia, warranty claims will be assessed in accordance with this Warranty Policy. The ACL guarantees apply only to purchases made in Australia.
12. Changes to This Warranty
We reserve the right to amend this Warranty Policy from time to time. Any changes will apply prospectively and will not affect warranty claims for products purchased prior to the change.
